Terms of Service for Artists on Wiggly Canvas
Welcome to Wiggly Canvas! We’re excited to support your art business. By subscribing to sell on our platform, you agree to the following terms and conditions. These terms apply depending on the type of art you’re selling—whether it’s original artwork you ship yourself or digital downloads/photo prints for which we handle production and shipping.
1. General Agreement
When you sign up as an artist on Wiggly Canvas and upload your artwork for sale, you agree to these Terms of Service. You are responsible for complying with all applicable laws and regulations regarding your artwork. We reserve the right to update these terms as necessary and will notify you of any significant changes. Your continued use of the platform indicates acceptance of these updates.
2. Types of Art Sales
Wiggly Canvas allows artists to sell two types of artwork on our platform:
- Original Physical Art: These are artworks that you, as the artist, will ship directly to the buyer.
- Photo Prints and Digital Downloads: These are high-quality prints and digital files that we, Wiggly Canvas, handle all aspects of processing, production, shipping, returns, and customer service on your behalf.
3. Selling Original Physical Art
- Artist Responsibility: When selling original artwork, you are responsible for the production and shipment of your items. You will need to provide accurate weight and dimensions for each piece to set up the appropriate shipping methods and rates.
- Shipping Methods: Wiggly Canvas will assist you by integrating the shipping profiles based on the weight and dimensions you provide. However, you are solely responsible for managing the actual shipment and handling of your artwork, including selecting your preferred carriers and managing any shipping delays or issues.
- Customer Service & Disputes: You are responsible for communicating directly with buyers regarding customer service matters, including any issues related to the artwork, shipping delays, or disputes. You must provide valid contact information on your artist page so that buyers can reach you for inquiries or concerns.
- Returns and Refunds: You are responsible for managing returns or exchanges related to your original art. Any return or refund requests should be handled directly between you and the buyer.
- Payment Collection: We collect payments for your sales on the platform and forward the funds to you after deducting applicable processing fees. Please note that the collection of sales tax and VAT will be handled by us on your behalf, but you should ensure that you remain compliant with any applicable local tax laws.
4. Selling Photo Prints and Digital Downloads
- Wiggly Canvas Responsibility: When you list photo prints or digital downloads (such as downloadable artwork files), Wiggly Canvas handles all aspects of the transaction including production, shipping, returns, and customer service.
- Production and Fulfillment: For photo prints, Wiggly Canvas will produce and ship the prints directly to the buyer. For digital downloads, the files will be automatically delivered to the buyer once the payment is processed.
- Customer Service and Returns: Wiggly Canvas is responsible for handling customer service and managing returns for photo prints. If a buyer requests a return due to production defects, we will manage the return process for you. However, if the buyer requests a return for reasons outside of production issues (such as changing their mind), we will handle those queries with your involvement.
- Payment Collection: As with original artwork, we will collect payments for photo print sales and remit the earnings to you after deducting applicable fees. Sales tax and VAT collection will also be handled by us automatically.
5. Taxes, VAT, and Reporting
- Tax Collection: We automatically collect sales tax and VAT for both original artwork and photo print sales during the checkout process. These taxes are remitted to the appropriate tax authorities on your behalf.
- Tax Reports: We will provide you with an annual tax and VAT report for your records. You are responsible for understanding your own tax obligations and maintaining accurate records. We recommend consulting with a tax professional to ensure compliance with tax laws in your country or region.
6. Shipping, Returns, and Customer Service
- Shipping for Original Art: You are responsible for setting up your own shipping profiles and managing the shipment of original artwork. You must ensure that all items are packed securely and shipped promptly.
- Shipping for Photo Prints: For photo prints and digital downloads, Wiggly Canvas handles all aspects of shipping and production, including providing buyers with tracking information.
- Returns and Refunds for Photo Prints: Wiggly Canvas will handle all returns and refunds for photo prints and digital downloads, including issues related to print quality and production errors.
- Returns and Refunds for Original Art: You, as the artist, are responsible for managing returns or refunds related to original artwork. This includes resolving any disputes or issues with buyers and handling customer inquiries.
7. Artist Conduct and Intellectual Property
- Ownership and Rights: You retain full ownership of the intellectual property rights to your artwork. By listing your artwork on Wiggly Canvas, you grant us a license to display and sell your art on the platform, as well as use it for promotional purposes.
- Prohibited Content: You agree not to upload or sell artwork that infringes on the intellectual property rights of others. This includes fan art or any work that uses trademarks or copyrighted material without permission.
- Conduct: You agree to provide accurate information and handle transactions professionally. Any fraudulent behavior, such as misrepresenting your artwork or failing to fulfill orders, can result in account suspension or termination.
8. Payment and Earnings
- Payment Processing: Wiggly Canvas will process payments on your behalf for both original art and photo print sales. Payments are transferred to you after deducting processing fees, taxes, and VAT.
- Payment Schedule: Payments are made on a regular schedule, and you will be notified of your earnings. You can choose the payment method that suits you best, whether through bank transfer or another method offered on the platform.
9. Liability and Disputes
- Wiggly Canvas Liability: While we provide a platform for artists to sell their artwork, we are not responsible for any disputes between you and your customers, including issues related to artwork quality, shipping delays, or payment problems. Any disputes related to original artwork should be handled by you directly.
- Dispute Resolution: If a buyer contacts us with a complaint about your original artwork, we will forward their inquiry to you for resolution. For photo print sales, Wiggly Canvas will act as the mediator between you and the buyer.
10. Termination of Account
- Cancellation: You can cancel your subscription to sell on Wiggly Canvas at any time. If you cancel, any open transactions will be honored, and your account will be closed upon completion of those sales.
- Suspension or Termination by Wiggly Canvas: We reserve the right to suspend or terminate your account if you violate any of these terms or engage in illegal activities. This includes the sale of unauthorized or infringing artwork.
